1. Introduction

Welcome to Old School Threads. By accessing or using our online store at oldschoolthreads.store and placing an order with us, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before making a purchase.

  • We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of our store after changes constitutes your acceptance of the revised Terms.
  • Our store is intended for customers in South Africa and is operated in accordance with South African law.
  • You must be 18 years or older to place an order. By using our store you confirm that you meet this requirement.

3. Products

  • All products are subject to availability. We reserve the right to limit quantities or discontinue any product at any time.
  • We make every effort to display product colours, designs, and descriptions as accurately as possible. However, we cannot guarantee that your device's display will perfectly reflect the actual product. Minor variations in colour or texture do not constitute a defect.
  • Prices are listed in South African Rand (ZAR) and are inclusive of VAT where applicable. We reserve the right to change prices at any time without prior notice.
  • Custom or personalised items (including screen-printed or embroidered garments) may not be returned or exchanged unless they arrive damaged or defective.

4. Orders & Payment

  • By placing an order you are making an offer to purchase the selected items. We reserve the right to accept or decline any order.
  • You will receive an order confirmation email once your order has been received. This does not constitute acceptance of your order — acceptance occurs when your order is dispatched.
  • Payment is due in full at the time of checkout. We accept payment methods available through our Shopify-powered checkout, including major credit/debit cards and other supported options.
  • All transactions are processed securely. We do not store your full card details.
  • If payment is declined or fraudulent activity is suspected, we reserve the right to cancel your order and notify you accordingly.

5. Shipping & Delivery

  • We deliver within South Africa. Delivery times and costs are outlined in our Shipping Policy, which forms part of these Terms.
  • Delivery timeframes are estimates only and may be affected by factors outside our control, including courier delays or public holidays.
  • Risk of loss and title for items passes to you upon delivery to the shipping address provided.
  • It is your responsibility to provide accurate delivery information. Old School Threads is not liable for orders lost or delayed due to incorrect addresses.

6. Returns & Refunds

  • Our Returns and Refund Policy governs all returns, exchanges, and refund requests and forms part of these Terms.
  • In accordance with the Consumer Protection Act 68 of 2008 (CPA), you have the right to return defective goods and request a repair, replacement, or refund.
  • Returns must be initiated within the timeframe specified in our Refund Policy. Items must be unworn, unwashed, and in their original condition with tags attached (except where the item is being returned due to a defect).
  • We reserve the right to refuse returns that do not meet our return conditions.

7. Consumer Protection Act (CPA)

Old School Threads operates in full compliance with the Consumer Protection Act 68 of 2008. As a customer you have the right to:

  • Fair and honest dealings.
  • Goods that are of good quality, free from defects, and fit for purpose.
  • Clear and accurate product information and pricing.
  • Return defective products and receive a remedy (repair, replacement, or refund).
  • Privacy and protection of your personal information in accordance with POPIA.

Nothing in these Terms limits or overrides your statutory rights under the CPA.

8. Intellectual Property

  • All content on this website — including but not limited to logos, graphics, product designs, photographs, text, and branding — is the property of Old School Threads and is protected by applicable intellectual property laws.
  • You may not reproduce, copy, distribute, or commercially exploit any content from our store without our prior written permission.
  • The Old School Threads name, logo, and brand identity may not be used in any manner that could cause confusion or imply endorsement without our express consent.

9. User Conduct

When using our store, you agree not to:

  • Use the site for any unlawful or fraudulent purpose.
  • Submit false or misleading information during checkout or account creation.
  • Attempt to gain unauthorised access to any part of our website or systems.
  • Engage in any conduct that could damage, disable, or impair the functioning of our store.

We reserve the right to terminate access to our store for any user who violates these Terms.

10. Limitation of Liability

To the fullest extent permitted by South African law:

  • Old School Threads will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our store or products.
  • Our total liability for any claim arising from a purchase will not exceed the amount you paid for the relevant order.
  • We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including but not limited to load shedding, courier disruptions, natural disasters, or connectivity issues.

12. Third-Party Services

Our store is powered by Shopify. Your use of the checkout and payment systems is also subject to Shopify's Terms of Service and Privacy Policy. We are not responsible for the practices of third-party service providers.

13. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the Republic of South Africa.
  • Any disputes arising from these Terms or your use of our store will first be addressed through good-faith negotiation. If unresolved, disputes will be subject to the jurisdiction of the South African courts.
  • You may also refer disputes to the National Consumer Commission (NCC) or relevant consumer tribunal in accordance with the CPA.

14. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable and will not affect the validity of the remaining provisions.

15. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, constitute the entire agreement between you and Old School Threads regarding your use of our store and supersede any prior agreements or understandings.
